Terms of service

These terms govern access to and use of the BotForge platform, APIs, and related services by your organisation.

1. Agreement to terms

By creating a workspace, accepting an invitation, or otherwise using BotForge, the entity you represent (“Customer”) agrees to these terms. If you do not have authority to bind that entity, you may not use the service.

2. The service

BotForge provides a hosted platform for designing, publishing, and operating Telegram bots, including the visual flow builder, broadcast delivery, audience segmentation, analytics, and administrative tooling. We may improve or modify features provided we do not materially degrade the service during a paid term.

3. Accounts and access

Customer is responsible for the accuracy of account information, for maintaining the confidentiality of credentials and bot tokens, and for all activity performed under its workspace. Customer must promptly notify us of suspected unauthorised access.

4. Acceptable use

Customer will not use BotForge to distribute unsolicited bulk messages, malware, or unlawful content; to harass or deceive recipients; to circumvent rate limits or platform protections; or in violation of the Telegram Bot API terms. We may suspend a bot that presents an imminent risk to the platform or its users, with notice where practicable.

5. Customer data

Customer retains all rights in the data it submits. We process that data only to provide the service, as further described in the Privacy Policy and the Data Processing Addendum, which is incorporated by reference where applicable.

6. Fees and billing

Paid plans are billed in advance on a monthly or annual cycle and are non-refundable except as required by law. Usage above plan limits is billed at the overage rates shown in the console. Fees exclude taxes, which Customer is responsible for.

7. Service levels and support

Enterprise plans include a 99.9% monthly uptime commitment with service credits, defined response targets by severity, and a named technical contact. Basic and Premium plans are provided on a commercially reasonable efforts basis.

8. Confidentiality

Each party will protect the other’s confidential information with at least the care it uses for its own, and will disclose it only to personnel and advisers with a need to know who are bound by comparable obligations.

9. Warranties and disclaimers

Each party warrants that it has the authority to enter this agreement. Except as expressly stated, the service is provided “as is” and we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of liability

Neither party is liable for indirect, incidental, special, or consequential damages. Each party’s aggregate liability is limited to the fees paid or payable in the twelve months preceding the event giving rise to the claim, except for breaches of confidentiality, infringement, or amounts owed.

11. Term and termination

The agreement runs for the subscription term and renews automatically unless cancelled before the renewal date. Either party may terminate for uncured material breach after thirty days’ written notice. On termination we retain workspace data for thirty days for export, then delete it.

12. General

These terms are governed by the laws of the State of Delaware, excluding its conflict-of-law rules. Notices must be sent to legal@botforge.com. If any provision is unenforceable, the remainder stays in effect.
